    Why is scalping legal? Because the state legislature says its legal. (Also, because ticket brokers have lobbyists, and fans don't.) Your so-called "free market" is actually the product of legislative action (or in some cases, inaction).

    I live in New York, where for years, there were tight restrictions on scalping. The ticket brokers all moved to New Jersey, along with a lot of tax revenue (we're talking the big broker organizations, not street scalpers, who of course don't pay taxes). Eventually, the ticket scalping law expired and the New York legislature didn't renew it. Money talks.

    This software costs a small fortune. So no, it's not within the reach of ordinary fans. And the software allows scalpers to circumvent per person ticket limits.


    Not if the law allows ticket sellers to impose restrictions on re-sale. Again, nobody's forcing you to buy the ticket. But if you do buy the ticket, you also accept the terms of the sale. And if the terms of the sale prohibit re-sales (or re-sales at higher than face value), then you could be in breach of contract if you scalp the ticket.
